Trademark Protection For Individual Names – A “Poison Pill” For Cybersquatters |

January 23rd, 2010

Author: Cheryl Hodgson

Should I register my individual name as a federal trademark?

The unequivocal answer for celebrities, sports figures, published authors, speakers and individuals marketing goods and services under their individual names is, “Yes.”

A registration allows clients and counsel to act quickly to prevent unauthorized use of individual names for marketing of competitive goods and services, a practice which is exploding on the Internet. Just as major corporations set up a “poison pill” to prevent uninvited take over attempts by competitors, individuals with trademark rights in individual names can use a trademark registration to serve the same purpose.

There are two major reasons to register an individual’s name as a trademark.

1. Provides access to speedy and less costly remedies afforded to trademark owners whose marks are contained in unauthorized domain names; and

2. Creates a poison pill against competitors purchasing marks as search terms and who use marks in Metadata.

The “right of publicity” is a legal doctrine used to prevent unauthorized use of a person’s name, image, or likeness for commercial purposes. Access to remedies for such violations is still limited to traditional, more expensive court proceedings. Moreover, the U.S. anti cyber squatting statute, 15 U.S.C.A. § 1129, provides for relief for theft of unregistered individual names only upon proof the registration was made with an intent to sell the name for a profit, and does not protect against competitive uses, which are much more common.

California Business & Professions Code § 17525 is another alternative that affords protection for names of deceased celebrities. It eliminates the requirement that registration be made with an intent to extort money. That is well and good, but how do California residents sue a cyber squatter based in Korea, over which there is no jurisdiction, i.e. the court has no authority to bind the party to its decision?

How Does a Federal Trademark Benefit the Individual?

A review of the most common forms of brandjacking provides the answer.

Unauthorized Use of an Individual’s Name in a Domain Name. What happens when an individual’s name ends up in the URL of a domain owned and used by a third party? There are two possible remedies.

Uniform Domain Dispute Resolution (“UDRP”). The arbitration may be filed before the World Intellectual Property Organization (WIPO) or one of several other approved ICANN dispute forums. A decision is made within two months of appointment of the arbitrator. Costs are substantially less than a court proceeding since all proceedings are in writing.

One must prove three elements to secure return of the domain:

• The disputed domain name is identical or confusingly similar to a trademark or service mark in which the Complainant has right; and

• The registrant has no legitimate rights in the mark; and

• Registration was made in bad faith.

The first element is established by providing a valid trademark registration. A federal registration proves the first element without need for further evidence of trademark use.

Contrast the result where there is no registration and the individual, albeit well known, loses.

David Pecker v. Mr. Ferris, WIPO Case No. D2006-1514. David Pecker, CEO of American Media, was unsuccessful in proving that he had “used his personal name for the purpose of advertising or promoting his business or for the sale of any goods or services.” Joacim Bruus-Jensen v. John Adamsen, WIPO Case No. D2004-0458.

Anna Nicole Smith c/o CMG Worldwide v. DNS Research, Inc., NAF Case FAO 0220007

“[T]the mere fact of having a successful career as an actress, singer or TV program star does not provide exclusive rights to the use of a name under the trademark laws. The cases require a clear showing of high commercial value and significant recognition of the name as solely that of the performer.”

Anti Cyber squatting Statute. The U.S. Trademark statute, Lanham Act § 43(d)(2) provides that the U.S. District court for the Eastern District of Virginia is available to file against offenders world wide holding domains with a U.S. registry. This remedy is based upon in rem jurisdiction, an age old doctrine that allows a court to exercise jurisdiction based upon the location of the property, and hails from settling property boundary and ownership issues, including notice to lost or unknown heirs. In the case of domain names, use of the § 43(d) anti-cyber squatting provisions is available only if the plaintiff’s mark is federally registered with the U.S. Trademark Office.

Protection from Sponsored Internet Ads and Use in Metadata

Search engines now auction search terms to the highest bidders, including

• Generic search terms- for example “discount airline tickets”

• Trademarks- for example: AMERICAN AIRLINES

• Individual Names

The first use is clearly not objectionable. But as more people bid on the descriptive term, the price goes up making its use cost prohibitive. Competitors start to look for less expensive ways to get their message out using other terms, including the trademarks and individual’s names associated with related products or services.

Courts have already ruled that a competitor purchasing the mark, or placing a mark in metadata to secure search engine ranking is liable for infringement under the concept of “initial interest confusion.” The controversial topic practice by Google of auctioning trademarks to competitors for sponsored listings is the subjection of pending lawsuits. Google has been turning a deaf ear, leaving the client to pursue only the direct infringer. Here are two examples:

A noted author’s name is being purchased by a competitor to promote a third party’s books and seminars. The author and the publisher must pay Google more for using their own names to advertise due to competitive bidding by infringers!

A popular discount filing service for trademarks markets its services on the internet by purchasing trademarks belonging to others. Our recent Google search of “XEROX trademark” turned up a sponsored ad by Legal Zoom, which is purchasing the mark XEROX® as a search term to advertise its trademark registration services! What’s the concern?

• The competitor is relying upon the good will existing in someone else’s name to promote their product, thus gaining a free ride to attract customers to their competitive product.

• The terms are bid upon through the Google auction process, forcing the author and the publisher of the books to bid against third parties to use the author’s name! The competition drives up the bid price charged to an individual using his or her own name to promote their own services, increasing Google’s profits and providing the trademark owner’s competitor with a platform.

Next time you perform a Google search, note rankings for products or services which pop up in the rankings other than for the one you keyed in. Some competitors are routinely including better known competitor’s marks in their metadata to gain ranking when the trademarked term is searched. This is an example of infringement by way of initial interest confusion and is illegal.

In sum, consider a federal trademark registration for goods and services sold and promoted under an individual’s name as a poison pill for cybersquatters. Major corporations take them to prevent unfriendly takeover attempts. Individuals should do the same with regard to unfriendly theft of domains. In the Internet Age, you will likely be glad you did.

The Future of Bronze Sculptures |

January 22nd, 2010

Author: Paul Yorktonieses

Bronze has long been in use by human civilization. Archaeologists had discovered artifacts that are made out of this metal. These artifacts are dated more than 5,000 years old. They usually consist of weapons. In the modern world, it is commonly used in sculptures, household items, and weapons. According to historians that traced the story of this metal, its use was first discovered the countries of Iraq, Iran, and Turkey around 3,500 B.C. Its value was also discovered by the Indians who immediately made use of them which was why there many archaeological bronze artifacts discovered in the Indian subcontinent.

Bronze is an alloy which is made up of aluminum, tin, and a small percentage of phosphorous and silicon. It is one of the favorite materials used by sculptors because it is ideal for their craft. The normal behavior of this metal is that when it is exposed to low temperature, it expands and when exposed to high temperature, it melts easily. During the Greek period, there was a revolution of life-like structures. This was when they knew how to incorporate the use of bronze sheet into the objects. The sheet is one of the welding consumables. Making statues improved with the introduction of clay models. To make them look better, a thin layer of wax is used to line them with.

After the welding consumables are put into place, they are secured further with iron nails. Molten wax is poured into the statue which is molded out of clay. The molten wax would fill up certain spaces. After the clay is removed, the statue then has hollow spaces which make them look real. This is called the Lost Wax technique. As of present, it has undergone various modifications.

Because of the inherent characteristics of this type of metal, it is one of the favorite materials used by sculptors. Most of them would use this material to make many other products such as decorative art items, candle stands, and sculptures. It is also ideal for use for objects which need to be placed outdoors, such as garden decorations, statues, and knob. This is because this type of metal is durable and heavily resistant to drastic weather conditions. Rusting is also pretty uncommon.

Most of the bronze statues have popular themes such as animals, people, wildlife, and nature. Depending on the personal taste of the artist, the object of the statue is interpreted differently. The statue affectionate can also choose among different bulk and size. They can resist rusting which makes them ideal outdoors.

Sculpting is one of the famous professions in the field of art. There are already a number of sculptors who have carved a place for themselves in the field. Yet, when the market’s demands exceeded what artists can provide, there are already fake sculptures which are distributed around. You will need a keen eye in classifying a real artist’s creation from a fake one. You may also buy a sculpture online because they have a wide array of choices.

TECHNOLOGY – An Essay |

TECHNOLOGY

An Essay

By

VIKRAM KARVE

DEFINITION OF TECHNOLOGY

In our everyday lives, most of us use a number of words that we assume have a universal, agreed-upon, and accepted meaning for all people in all contexts.

Often, the more frequently the word is used, the more we take for granted that our usage is the only possible usage of the term.

One such popular word freely bandied about and very much in-vogue jargon now-a-days is technology.

Let us explore the meaning of the word “technology”.

The word “technology” comprises two parts – “technikos” & “ology”

The historical derivation of the term technology comes from the Greek word technikos, meaning “of art, skillful, practical.”

The portion of the word ology indicates“knowledge of” or a “systematic treatment of.”

Thus, the literal verbatim derivation of the term technology is literally “knowledge of the skilful and practical.”

However, this definition is too general in nature and we have to transcend this narrow view of technology since every technology starts from a human purpose, from the intention to satisfy some human need or behaviour.

Indeed, technology is the manipulation of nature for human purpose – yes, manipulation of nature, so let us use a slightly different definition of technology.

We will define technology as the knowledge of the manipulation of nature for human purposes.

This definition retains the notions of both knowledge and practicality (human purposes) but adds the new concept of manipulation of nature.

This implies that all practical or technical skills ultimately derive from alterations or manipulation of nature.

Technology depends on a base in the natural world (Science) but extends the natural world through the phenomenon of manipulation (Engineering).

Since we want to manipulate nature, the ability to predict what nature will do when manipulated is most useful, indeed imperative.

ETHICS OF TECHNOLOGY

By our very definition, technology manipulates nature for human purposes.

Technology manipulates nature.

Man is a part of nature.

By manipulating nature, man manipulates himself.

Thus, technology manipulates man, influences, even governs human behaviour, and in turn impinges on societal behaviour, traditions and culture.

Technology is an entity that intervenes in the life of human beings in multifarious ways, directly or indirectly, trying to alter behaviours.

Thus, Technology has an Ethical Dimension.

The very raison d’etre of technology is human purpose.

What is the fundamental purpose of human life?

Is it to increase standard of living?

Is it to improve quality of life?

Or is it to have greater satisfaction in life?

We can distill all these various aspects into a single holistic concept: VALUE OF HUMAN LIFE.

Thus, the cardinal aim of technology is to enhance the value of human life.

TECHNOLOGY and the VALUE OF HUMAN LIFE

Let us define the value of human life as the balance or ratio between satisfaction or happiness and pain or suffering.

In the context of this definition, the ultimate purpose of technology is to enhance the value of human life, with a long-term perspective, by maximization of happiness and satisfaction and a concomitant reduction or minimization of pain and suffering (physical, mental and emotional).

As a generalization, people want a better life.

A better life may usually mean things like freedom from want, access to and possession of at least some of the “nonessentials”, comforts or luxuries, good health, a reasonable life expectancy, the absence of emotional stress, satisfying human relations (resulting from gratifying work experience and meaningful interpersonal relationships), intellectual stimulation, and personally rewarding leisure activities.

HUMAN NEEDS and VALUES

Human needs and values change through time as technology advances.

Man tends to accept the fruits of new technology more readily (satisfaction, happiness, comfort) whereas he is reluctant to accept changes in his personal life.

Thus, social and cultural changes always lag behind technology causing a mismatch and disconnect which consequently leads to unhappiness, dissatisfaction, pain and suffering (emotional) and concomitant lowering of the value of human life.

A crude but practical way of classifying human values is to divide needs into those that are essentially physiological and those that are psychological.

Most new technologies cater to the physiological aspect by performing Dangerous, Dirty, or Difficult jobs (the 3 D’s) thereby enhancing the value of human life.

As regards the psychological aspect, an example pertaining to Information Technology (IT) may be in order.

Information Technology (IT) caters to two unique categories of psychological needs of humans:

Cognitive Needs – which refer to the human need for information so as to be ready to act or make decisions that may be required, and

Affective Needs – which refer to the emotional requirements of human, such as their need to do challenging work, to know their work has value, to feel personally secure, and to be in control.

Undue emphasis on cognitive needs and consequent neglect of affective needs may cause emotional pain that counterbalances the gains from technology and this may be detrimental to the “value of human life” as a whole.

TECHNOLOGY IMPACT ASSESSMENT

Effects and Consequences of Technology

In our haste to milk technology for immediate economic advantage, we often lose sight of the long-term consequences: the higher order and indirect effects, especially the delayed and unintended effects of technology.

The Sorenson multiple effect network methodology is a useful technique for an analyzing the impact and consequences of technology.

Let us introduce the term malefit to represent harmful effects and consequences of a technology in contrast with benefit as a useful output.

We may categorize the consequences of a technology [Effects vs Consequences] as:

EFFECTS CONSEQUENCES

(i)         First Order                  :           Benefits

(ii)        Second Order              :           Direct Malefits

(iii)       Third Order                 :           Indirect Malefits

(iv)       Fourth Order               :           Unintended Malefits

(v)        Fifth Order                  :           Delayed Malefits

Such analyses definitely help in assessing the impact of various consequences of a technology on the value of human life in the long-term perspective in holistic manner.

Early identification of factors detrimental to the value of human life may prove useful in technology impact assessment to reduce mismatches and smoothen out incongruities.

CONCLUSION

We must not lose sight of our basic premise that the cardinal aim of technology is to increase the value of human life by maximising happiness and minimising suffering.

Ethical Technology Management comprises a harmonious blend of rational thinking and empathic understanding wherein one studies, analyses and mitigates the conflicting interplay between human cognitive and affective processes.

It may be apt to conclude with a comment by RM Pirsig, who states that, “The way to solve the conflict between human values and technological needs is not to run away from technology. That is impossible. The way to resolve the conflict is to break down the barriers of dualistic thought that prevent a real understanding of what technology is… not an exploitation of nature, but a fusion of nature and the human spirit into a new kind of creation that transcends both”.

Taser X26C Device |

January 20th, 2010

Author: Richard Armen

If you’re looking for an effective and easy to use method for protecting yourself against violent crimes, consider a TASER device. The TASER X26C is one of the newest TASER models to hit the market, and it is one of the most efficient ways of stopping any attacker. In fact, it is based on the TASER X26 model, long used by long enforcement for stopping dangerous criminals in their tracks. The law enforcement version, the X26, is currently used by more than 11,000 law enforcement officers all over the world. Since 1994, over 100,000 TASER devices have been sold to private citizens. Now that the X26C is available to civilians, you can take advantage of the very same technology.

The TASER X26C is known as an Electronic Control Device. Simply aim your TASER device at the attacker and fire it; two wires with metal probes are propelled from the device to the attacker. The probes on the TASER X26C can penetrate up to two inches of clothing to complete an electrical circuit. When used on an attacker, these probes deliver a 10, 20, or 30 second burst of energy which interrupts signals from the brain to the muscles. This is a nonlethal method of making your attacker completely unable to keep attacking you. It is effective up to fifteen feet away from the target. More than 95 percent of attackers are instantly disabled using the TASER X26C. A powerful TASER device can keep attackers from getting their hands on you by temporarily disabling them from a safe distance.

In addition to the electrical pulses from a distance, the TASER X26C model can also be used like a stun gun in the event that your attacker is able to come within arm’s reach. It also utilizes an Anti Felon Identification System (AFID), which disperses specially designed pieces of “confetti” that have been marked with a serial number. When the TASER device is used, these pieces enable law enforcement to identify the owner of the TASER device once the target has been apprehended.

The TASER X26C device measures approximately six inches in length and weighs just seven ounces, making it ideal to carry in a holster on your belt or in a handbag. The X26C is smaller and lighter than previous TASER models, yet it is engineered to deliver the same or greater incapacitating power. The TASER International Inc., the maker of TASER devices, requires all owners to pass a background check before it is activated. By registering your TASER, you also get the added benefit of a replacement device if you use the TASER for self defense and must leave it behind when you escape the situation.

No one expects to be attacked, and too many people are caught unprepared when this happens to them. By carrying a TASER device such as the new X26C model, you can prepare for the worst possibilities. No matter what the situation is, you can feel safe knowing you have something to protect you. TASER has long been synonymous with effective protection devices used by both law enforcement and private citizens. TASER International Inc. has continued this tradition with the X26C.

What to Take Into Account Before Buying a Car |

January 19th, 2010

Author: Carl Castro

The first thing that you need to do is determine what you can afford. If you are making a cash purchase, then determine how much you want to spend or can afford to spend. For most car buyers, some form of financing will be involved. To figure out your payment amount, figure how many months you want to pay (the term of the loan) and how much you want to put down as a down payment. There are payment calculators all over the internet that can help you figure out what your payment would be based upon the amount financed.

You should limit your loan term to 60 months. Any longer of a term is unwise. The reason for this is that your car will depreciate dramatically over time. The longer you pay the greater that chance that you will owe more than the car is worth. You are not paying it off as quickly so what will end up happening is that you will want to get rid of the car because you are either no longer interested in keeping it or need to get another one because your car is no longer running.

What may happen is that you will go to trade in your car that is worth $500 – $1500 and you will still owe $3000 – $4000 on it. Now either this makes the replacement vehicle too costly because that money needs to be made up somewhere and would probably be rolled into the new loan or it just may not be feasible at all. The bank may not allow you to roll this into the new loan. This situation is much more likely as your term of the loan grows. This is why it’s better to go no longer than 60 months on a car loan.

Your payment should also not exceed 20% of your net monthly income. That is, 20% of your total monthly income after taxes. Any more than that can affect your ability to pay other bills each month. If the car you are looking at is more per month on a 60 month loan than you budgeted for, then you may be looking at the wrong car.

When you look into the long-term costs of owning a car you need to include one very important item, car insurance. Most people are so preoccupied with the car they are buying that they forget to call their insurance company and get a quote on the car they are looking to buy. Depending on the car you are buying, your insurance costs could go up a great deal, especially if you are buying a new car.

Generally speaking, the newer the car, the higher the insurance costs. These costs need to be figured into your monthly expense for your car. Add what you pay now for a car payment and car insurance together and that is your total cost of your car per month. If you pay your insurance every year then divide it by 12 in order to figure out a monthly cost. Compare it to what you are paying now to see if you can afford the jump in costs.

The requirements for auto insurance do vary from state to state so make sure that you are not purchasing more insurance than you need. You should also keep in mind that there are four states in the United States that do not require a driver to have liability insurance on their car if it is not financed or leased. Those states are New Hampshire, South Carolina, Tennessee and Wisconsin. Even though they do not require insurance in those states does not mean that most people are uninsured in those states.

Most people do not want to be held personally liable and make the right choice by purchasing car insurance. They would rather do that than risk losing everything they own after they are involved in an accident. Please remember, an accident is not something you plan or can foresee in the future. Protect yourself with insurance before an accident comes around the corner and hits you.

5 Critical Steps in Assessing Why Your Computer is Freezing Up |

January 18th, 2010

Author: Ahmet Dagseven

Freezing and crashing can be infuriating for computer users and very expensive if you take it to a PC repair shop, and this will not always be the best solution. Firstly check if your computer is really frozen an easy way to determine if you computer is frozen is by pressing num lock button on the keyboard and watching the num lock led light to see if it turns off and on. Although the above num lock trick is a good indicator give it a minute before turning it off.
There are several reasons why your computer is freezing. First when was the last time you cleaned your registry. Having a corrupted registry can cause a whole host of errors and problems. Freezing is just one of them. If you have a lot of unnecessary registry keys that are clogging up your computer resources.

Your computer will be blocked and choke scan your registry with a good registry cleaner. If you have more than 20 errors or replication, clean your registry.

1. Depending on your RAM specs and your computer usage. This could also be the issue. Having an insufficient amount of free space does not allow your RAM to function properly. If you are using a lot of RAM by surfing on the internet or other activities without enough empty space you will get freezes. You don’t need to buy new RAM but you should increase your free space by removing unnecessary data and perhaps increasing your virtual memory. Follow the steps below to increase your disk space.

2. Stop problems related to low disk space by running a disk clean up. Click on your “Start” button. Go from the “All Programs” heading up to the “Accessories” heading. From there go to “System Tools” and click on “Disk Cleanup.” Follow the prompts in the “Disk Cleanup” menu to free up hard drive space and end freezing problems. Also, store any large files on an external hard drive or DVDs to save additional space and remove any seldom used programs.

3. Unfreeze you computer by ending a crashed program. On your keyboard, hold the buttons Ctrl+Alt+Del and click “Task Manager” on the menu that appears. Locate any program with the status “Not Responding” and right-click on it. Choose the option to “End Task” to terminate the stalled program.

4. Check out your hardware drivers. This could be the problem if new hardware has been added to the system. So, the drivers should still be up to date. So try the first two suggestions and see if you can get your computer to stop freezing. Check your drivers.

5. Related freezing problems by running your antivirus and spyware scanners. Depending on the amount of damage done by the virus or spyware, running a scanning program may not be enough to remedy the problem; sometimes a complete reformat and reinstallation is required.

Stunning Ford Mustang |

January 16th, 2010

Author: Tony Hilton

The Ford Mustang (especially the 2007 version) is officially my very favourite car. I love the lean mean lines, and the shape of the chunky grill. I also love the wonderful noise the engine makes and it first purrs, then roars into life.

The new edition 2010 Ford Mustang is a beast of a car. It is, rightly so, completely uneconomical, and as such becomes a true gas-guzzling American Beauty, built on a long and illustrious heritage and company history. The powerdome hood leads from that aggressive and powerful front through to the low and far back sunken driving seats, where you and your very favourite passenger can survey the road. There is something in that laid back exterior that makes the Ford Mustang seem both calm, and like something much more energetic is bubbling away beneath the surface.

That “energy” is probably the Mustang’s 4.6 litre SOHC V8 engine. With more horsepower than the previous models, the 2010 Mustang really enjoys its expansive engine capacity to the max, especially if you have a chance to enjoy roaring along a long straight American road with the pedal to the metal. This is when the styling really comes into play, providing the engine with a lovely aerodynamic piece of kit to force through the air and simply blow away any semblance of friction or resistance!

This combination of fearless good looks, easy going yet powerful engine capacity, and a certain hefty dose of the American dream make this car really popular for a very specific kind of holiday. As well as importing these muscle cars into the UK for people who just can’t find anything equivalent on this side of the ocean, people seem to just love driving them. The holiday of a lifetime for these individuals may just be a road-trip down the coastline of America, in your own luxury soft top Ford Mustang.

These holidays are about more than driving a car, and more than having a break. The friends that I know who have been on such exciting bespoke trips have informed me, reasonably reliably, that taking a road trip in a Ford Mustang is more about feeling the car in its natural environment than it is about anything else. Whistling past the stunning USA scenery, pulling into remote lay-bys or staying a cute hotels (motels?) – every single element is part of the overall package.

Casting images of old black and white horror movies aside, I have to admit that a trip in a Mustang would be worth doing. If only because the cost of importing and then running a Ford Mustang becomes astronomical very quickly, the idea of having your car purely to holiday is sounds incredibly tempting and more than a little bit decadent! Whilst I will still aspire passionately towards importing my own Mustang (preferably a 2007 model…), perhaps a trip in a real beauty will give me the reins and prepare me for the ownership that will one day be mine all mine.

What To Choose: Foreign Cars Via Domestic Cars? |

January 14th, 2010

Author: Bruce Fisher

When buying a car, you should consider four main factors – quality, price, value and reliability. A car may have one or two factors but be missing the other two. You need to find a car that has all four factors. Foreign cars tend to be more likely to possess the four factors.

Quality is the workmanship and durability of a car over time. Many foreign cars, especially mid-size cars, can have a very long, useful life. There are many of these cars still on the road well after 100,000 miles of use. Domestic cars, on the other hand, tend not to last much past 100,000 miles even if cared for well.

A foreign car will tend to be more durable and will have fewer problems than a domestic car with the same mileage. Consumer reports wrote that both Honda and Toyota were consistently better over time then the major domestic manufacturers. During a survey, they reported that Honda and Toyota were at least 55 problems per 100 vehicles better than the next closest competitor. Ford, which is considered to have an average amount of problems.

Price is not just the number on the window sticker. Price includes long term costs such as maintenance and repair bills. Domestic cars may be a little cheaper than foreign cars on the average. It seems the long term costs of owning a domestic car are greater. They tend to have more problems down the line during the life of the car. The cost of getting a domestic trade-in ready for sale on the lot is usually higher than getting a foreign car ready for sale. If you ask any mechanic which type of car has better service histories, they all say that as a whole, foreign cars were usually better running and easier to maintain. They also added that domestic cars were easier to work on although they felt that a foreign car would hold up better over time.

Value is described as what your car will be worth over time. The easiest way to determine this is to look at resale values. The resale value and trade-in value of foreign cars generally hold up better over time than domestics. This has to do with quality and price which we just discussed. Another way to determine this is to look at lease programs. Foreign cars generally have higher residual percentages and therefore lease better than domestic cars.

A Honda Accord leased for 3 years may have a residual value of 55% while a Chevrolet Impala comparably equipped and priced may have a residual value of 40%. Even the banks know there is a distinct difference in value over time. They are the ones that set the values. This is why more people lease foreign cars over domestics.

Reliability is the ability of a car not to break down over time. Sometimes it is referred to as dependability. Like we discussed earlier, mechanics tend to side with the foreign cars. Consumer Reports even claims that Asian vehicles are by far the most reliable in their latest subscriber survey. The vehicles in Consumer Reports are graded on a rating of problems per 100 vehicles. Asian vehicles have reported about 12 problems per 100 vehicles. European makes remained steady at 21 problems per 100 vehicles.

As you can see they do not have the reliability ratings that Asian car makers do. Oddly enough, in the same Consumer Reports subscriber survey, U.S. makes had an average problem rate of 18 problems per 100 vehicles. That was up from the previous year of 17. That is a better rating than the European models. Don’t look at these numbers and think that all cars from a certain area of the world are the same. The results vary significantly within each group and should be researched more before purchasing a vehicle.

BODYBUILDING ARTICLES.Effective fat burning |

January 14th, 2010

Plus, these workouts consist of exercises and techniques that do not exercise the body in the way it is normally used so they end up building a somewhat unusable strength. In my opinion, most people, unless their main objective is bodybuilding, shouldn’t perform the traditional style workouts

While I do still believe that machine and free weight strength training is the best choice for body building, it is NOT the best choice when it comes to general fitness goals like strength, flexibility, endurance, etc.

I don’t know about you, but I can barely fit in 15 minutes for exercise let alone 2 hours… and I personally am not interested in muscle size alone (which doesn’t mean strength and usually leaves you stiff and inflexible)! I’m sure your schedule is probably the same. The good news though is you don’t have to… you can burn fat, increase flexibility, build unbelievable strength and endurance, reshape your body, and build a level of fitness that is truly functional.

I want to share with you a workout that I do personally that delivers a great combination of strength, flexibility, cardio and muscular endurance, and fat burning.

WARNING: The following workout will not only surprise you, but it will likely go against everything you ever thought to be true about fitness. Also, it is recommend you consult your physician before beginning any exercise program.

Are you ready? Good, here it is:

The following exercises should be performed with little or no rest between and you may need to adjust the number of repetitions or time depending upon your current fitness level.

    * Jumping Jacks -1 minute

    * Bodyweight squat (one-leg squat for advanced) – 15-20 reps

    * Push-ups (slower reps for advanced) – as many reps as possible

    * Kick butts (jog in place and kick your rear with both heels) – 1 minute

   * Hamstring floor bridge (use swiss ball or one leg for advanced) – 15-20 reps

    * Superman (lying on stomach w/ arms out to side, lift legs and chest off floor) – 15-20 reps

    * High knees (jog in place lifting knees as high as possible) – 1 minute

    * Stationary lunge – 15-20 reps

    * Torso rotations/twists – 20 reps each direction

    * Side bends/reaches – 20 reps each direction

    * Mountain climbers – 1 minute (if you can J)

    * Wall sit – as long as you can hold it

    * Dips (use chair/bench/stairs) – as many reps as possible

There you have it… sounds easy, right? That couldn’t possibly do anything, right? I personally challenge you… try it… no, try it right now! Drop what you are doing and give it a shot and see for yourself. If you find it a bit easy, which I doubt, perform it 2-3 times through without rest. This workout will deliver more usable fitness results and benefits than any traditional gym or health club workout. Now, you can of course implement this type of workout in the gym and make it even better, but the beauty of this is you can do it anywhere! Also, this is just one example and as you can imagine, there thousands of other exercises you can add or replace… I actually recommend switching the exercises every 2-4 weeks or even better is to put together 3 or 4 different workouts and then rotate them.
